Early Tuesday February 26th, two separate Colorado counties voted to declare themselves Second Amendment Sanctuary counties.  Both Fremont and Montezuma counties held their regular Board of County Commissioners meetings and either passed or started the process to pass resolutions stating if Colorado’s HB19-1177: Emergency Risk Protection Orders (ERPO) is passed into law, they will not enforce it.

HB19-1177, which is Colorado’s proposed Red Flag gun control legislation passed the House Judiciary Committee last Thursday after nearly ten hours of testimony for and against.  Dozens of those wishing to testify in opposition to the bill had already left when they were called up to testify at 9 and 10 o’clock at night.  Many of those who were not able to speak had been there since noon.

In Fremont County, Chairman Dwayne McFall led the initiative in direct response to HB19-1177, which he says violates multiple Constitutional amendments.

In Montezuma County, more than 100 people attended and many shared their comments about the Red Flag legislation being considered.  The Board of County Commissioners were said to be transparent and shared a copy of the resolution with those in attendance indicating the county’s position against a Red Flag ERPO law, calling it a dangerous infringement on the Second Amendment and civil liberties.  Montezuma County Sheriff, Steve Nowlin, was also in attendance and supported the resolution.  The final draft of this resolution will be discussed in a Special Meeting on Thursday, February 28th at 6:30 p.m. The public is invited. 

Many other sheriffs in Colorado — including El Paso County Sheriff Bill Elder, Weld County Sheriff Steve Reams, Teller County Sheriff Jason Mikesell, and Fremont County Sheriff Allen Cooper — say they don’t approve of the bill as written because they believe it infringes on citizens’ rights to due process. Even Democrat Sheriff out of Pueblo County, Kirk Taylor, says he doesn’t believe there are adequate due process protections for gun owners in this year’s version of the bill.

Colorado’s proposed “Red Flag” legislation is one of the worst the U.S. has ever seen. This year’s bill is being called an “Emergency Risk Protection Order” or ERPO in an attempt to lose the negative “Red Flag” reputation.  It is also being pushed more than ever as being about suicide prevention.  Don’t let any of it fool you.  The devil is in the details; it’s in the 30 pages of bill language.  You can read a complete break down of these 30 pages here, as well as watch a video going through the language line by line.

Here’s what you’ll hear the media say this bill does:

A family member or law enforcement officer would petition a court to request the ability to immediately seize a person’s guns. If a judge signs the order, the weapons can be taken away and the court must hold a hearing within 14 days to determine whether to extend the seizure and bar the person from purchasing more firearms.”

Here’s what they wont tell you: 

• Almost anyone can request an ERPO without even showing their face or providing their address. The definition of “family or household member” is so broad it includes ex-lovers who you have never even lived with!  Or someone *claiming* you once had an affair.  And even old roommates.

• The initial report and hearing can be done over the phone, all while the accused is completely oblivious proceedings are taking place to have his or her firearms confiscated.

• The first time the accused learns someone has reported them will be when local law enforcement shows up at their door with an order AND a search warrant prepared to raid your home – while the accused never even committed a crime.

• 14 days later is the first time the accused will have a chance to defend themselves against this non-crime.

• The guns will be confiscated for 364 days, during which time the accused only has one opportunity to ask the courts to lift the order.

• There is zero accountability for false accusers. In fact, the filing fee is $0! For comparison, requesting a Temporary Restraining Order in Colorado is $97.

• This bill is being touted as a “suicide prevention” bill, when in fact, the fear of having your firearms confiscated will make people terrifed to ask for help when they need it.

• It is so rife for abuse, it can easily be used by someone’s stalker or abuser to have their victim disarmed – legally.

• The ERPO will go on a person’s permanent record EVEN if it is dismissed, meaning it will show up on background checks, etc.

I attended the hearing last week to testify in opposition to this bill.  I arrived at noon and was the very last person to be called to testify – nearly ten hours later.  After listening to testimony all day, I decided rather than once again testify to how unconstitutional the bill is or how it lacks due process, I’d instead testify to my own experience having the legal and judicial system used against me as an act of harassment during a 22 months custody battle.

    If Coloradans are going to sit idle for this confiscation and surrendering of Constitutionally guaranteed rights my question is this, what are you going to surrender next your children, property, car, food, etc? Do you honestly believe your guns are all that they want you to surrender? And do you honestly believe the purposes they have listed for surrender of your rights will not be expanded upon and broadened if you accept this now? This is why they were smiling in the video Lesley posted.

    Why the “Red Flag Law” will fail miserably

    The law of unintended consequences will rear its ugly head in many different ways.

    1 The court in Warren v. District of Columbia (444 A.2d. 1, D.C. Ct. of Ap. 1981) ruled: “the fundamental principle that a government and its agents are under no general duty to provide public services, such as police protection, to any particular individual citizen.” The duty to provide public services is owed to the public at large, and, absent a special relationship between the police and an individual, no specific legal duty exists. IE: There does not exist any duty for the authorities to protect any person nor to prevent any crime; and the authorities exist only for the protection of society at large. This law will codify that relationship to individuals who are a threat to themselves. Absent that protection, or the failure of the efforts to protect that person, this law will open the floodgates for litigation against the authorities by the surviving family members.

    2 This law will require that the authorities instigate hostile actions against individuals, where firearms are known to be present, thereby endangering officers and placing them in harm’s way.

    3 The law does nothing to remove other equally dangerous weapons and instruments from the person’s home – sharp instruments, chemicals, flammable liquids, striking instruments, car keys, etc. – and assumes that the individual would not use those instruments to harm themselves or others.

    4 The law simply disarms the individual and then leaves them to their own devices. There is no provision within the law to provide any medical or mental help to that person.

    5 Within an hour of their firearms being removed an individual could simply step into their three ton weapon of mass destruction and drive to a sporting goods store where they could purchase a black powder weapon and black powder with which to harm themselves or others. Black powder arms are not regulated as firearms (18 USC 921 (a) (16)). There is no need to purchase them from an FFL, fill out a 4473 Firearms Transaction Report, or go through a background check.

    5 Upon realizing the above, the legislators would immediately try to bring black powder arms under the umbrella of firearms. They would find themselves deeply disappointed if they tried. Black powder arms are exempt from the firearms laws and are considered to be antique arms using primitive ignition systems (18 USC 921 (a)(3)). The only body authorized to amend the United States Code is the Congress of the United States.

    7 ATF NICS has already told two other states (California and Nevada) that they are not responsible for running background checks on non-firearms related transactions. Black powder arms do not fall under the classification of firearms and ATF NICS would refuse to run background checks on those black powder arms.

    This legislation is filled with feel good provisions which in reality endanger police officers and place them in harm’s way. It does nothing to actually disarm those who are the subject of the legislation.

    One can only wonder how these legislators will feel when there is a two mile procession of emergency vehicles driving past the capitol carrying an officer, killed during one of these raids, to their final resting place.

      WHEREAS, it is the desire of the Board to declare its support of and allegiance to the Second Amendment of the United States Constitution and Article II, Section 13 of the Colorado Constitution, both of which protect and guarantee the inalienable and individual right to keep and bear arms; and

    Eugenics by gun control raises the question in my mind of how close are they from citing innocent drivers when the thought police think you may speed while driving in the future though the citizen has not done so yet? It’s a radical unconstitutional concept.
    If the eugenics gun control bill is so lawful and constitutional then why are Sheriffs and Commissioners hesitant to enforce it? There wouldn’t be a debate if the eugenics gun control was lawful but since it’s not it goes against the very oath LE has sworn to when promising to adhere to the Constitutions. The 2 Constitutions guarantee that both the USA and Colorado are both entirely a second amendment sanctuary.

        Here’s the bio diversity map though I must warn you it to is a scam because they want every single person off of rural lands pushed into the super city for depopulation down to 500 million head total or less globally.

          I agree that that the gates and fences are a great way to frustrate their actions. My last post about rally folks waiting for a semi auto bill was simply about using the resources of this group in an efficienct fashion. More people would join a recall effort over it, than over ERPO. I fully agree the end game of the OPPO is people control. However the average firearms owner isn’t going into the trenches, figuratively or politically,until they personally feel the heat. It will take a bigger issue than ERPO

            The “bigger issue” is headed right for them. They are on a collision coarse of astronomical proportions.

            I was at the grocery store yesterday and barely could park in the lot due to sudden increase in volume of shoppers that is unprecedented and they were all walking at a pace just below that of jogging while shopping. Even folks in their 60’s. Reminded me of shoppers prior to a major hurricane. They wreaked of urgency for no apparent reason. They couldn’t hide their stress. It was absolutely all over them. Every one of them. They feel the heat there is no doubt. Their frog is heating up. It won’t be long now for them/us. Lol.

            We are receiving letters on state letterheads demanding access to inside our homes and we do not comply!

            We are having our homeowners insurance companies demand we bulldoze every piece of vegetation on our properties down to bare earth and clear cut every single tree threatening us with policy termination and we do not comply!

            The gestapo come in the night and park outside to threaten us. We watch them, they watch us.

            I have heard these things can’t happen in America and know for a fact it is a myth.

            Tick tock, tick tock!

    I would also add that city dwellers could frustrate them by first looking out the window when the doorbell rings. Does it look like the law? Well, don’t answer the door to allow them to serve you papers. Unless you physically take and read them, and let them in,they can’t enter under ERPO . Don’t answer the door. Force them to violate your rights by crashing your home before serving papers. Now that will will look great in the news.
    Hide your quality firearms so nothing they can find but your low grade stuff.
    We still have the ability to publicize that kind of crap actions.

      Unless a person knows they have broken the law or done something wrong to warrant gestapo showing up at their home they should never ever for any reason answer the door or phone for that matter unless they know who the caller is. Around here they even show up with fake warrants so don’t be fooled. They have been doing this for at least 11 years now. It really blows all their credibility to hell by using fake papers unless of coarse they succeed with it by fooling their intended target because dead men tell no tales.

      We even have gestapo showing up in these parts producing out of state credentials which according to my attorney is a crime. They go door to door. It’s quite the show.

      Being lawful is not defined as obeying unconstitutional laws the United States Supreme Court has written in many cases throughout our history. They have repeatedly written that unconstitutional laws are by default null and void from inception. That just because some bureaucrat/legislature has a whim to write words on paper doesn’t mean those words supersede the supreme law of the land known as the Constitution and it is every patriots duty to disregard such words that conflict with Americas founding documents because to adopt such words would be to be complicit in the destruction of one’s nation and that is exactly the unlawful type of activity I will not participate in. I refuse to destroy my own country.
